1. Acceptance of Terms

By downloading, installing, or using the LizSpeedTest application ("App"), developed by Liz Media ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

These Terms apply to all users of the App, including users on Google Play and any other distribution platforms.

2. Description of the App

LizSpeedTest is a free Android application that allows users to measure their internet connection speed, including download speed, upload speed, ping (latency), jitter, and packet loss. The App connects to a global network of distributed speed test servers to conduct measurements.

Key features include:

• Real-time download and upload speed measurement
• Ping, jitter, and packet loss measurement
• Automatic or manual server selection from a global network of speed test servers
• Local test history (up to 300 records, stored on your device only)
• Multi-language support
• Customizable speed units and connection modes

3. License Grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use the App on Android devices that you own or control, solely for your personal, non-commercial purposes.

You may NOT:

• Copy, modify, or distribute the App or its source code without our express written permission.
• Reverse engineer, decompile, or disassemble the App, except as permitted by law.
• Use the App for commercial purposes without our prior written consent.
• Use the App to deliberately overload, attack, or disrupt network infrastructure.
• Remove, alter, or obscure any proprietary notices in the App.

4. Acceptable Use

You agree to use the App only for its intended purpose — measuring your own internet connection speed. You agree not to:

• Use the App in any way that violates applicable local, national, or international laws or regulations.
• Conduct automated, scripted, or bot-driven speed tests in rapid succession that would constitute abuse of third-party speed test servers.
• Use the App to interfere with or disrupt any network, servers, or infrastructure.
• Attempt to circumvent or disable any security features of the App.
• Misrepresent test results for fraudulent purposes (e.g., disputing internet service provider contracts based on manipulated results).

5. Third-Party Services

LizSpeedTest relies on a global network of third-party speed test servers to provide speed measurement infrastructure. Your use of the App implies acceptance that:

• Your public IP address is transmitted to these servers as a technical requirement of performing any speed test.
• Anonymous test data packets (upload/download payloads) are exchanged solely to measure network performance.
• The availability of these servers is outside our control; if they are unavailable, core App functionality will not work.

We do not use any advertising networks, social media SDKs, analytics platforms, or other third-party tracking services.

6. Accuracy of Results

Speed test results are provided for informational purposes only. Results may vary based on factors including but not limited to:

• Your device's hardware capabilities and background processes
• Network congestion at the time of testing
• Geographic distance to the test server
• Interference from other applications or network users
• Wireless signal quality (for Wi-Fi or mobile data connections)

We make no warranties or guarantees regarding the accuracy of test results. Results should not be used as the sole basis for formal complaints, legal disputes, or contractual claims against internet service providers without corroborating evidence.

7. Intellectual Property

All rights, title, and interest in and to the App (excluding third-party speed test infrastructure and third-party libraries) are owned by Liz Media. The App, including its design, code, icons, and branding, is protected by applicable intellectual property laws. The "LizSpeedTest" name and logo are the property of Liz Media.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
• Warranties regarding the accuracy, reliability, or completeness of speed test results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIZ MEDIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP (WHICH, IF THE APP IS FREE, IS ZERO).

10. Updates and Modifications

We may update the App from time to time to add features, fix bugs, or comply with changes in third-party APIs or platform requirements. We may also update these Terms at any time. The updated Terms will be posted at this URL with a revised "Last updated" date.

We reserve the right to discontinue or modify the App at any time without notice. Continued use of the App after changes to these Terms constitutes your acceptance of the revised Terms.

11. Children's Use

The App is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you are under 13 years of age, please do not use the App. If you are a parent or guardian who believes your child has used the App, please contact us.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the developer's jurisdiction of registration.

13. Termination

We reserve the right to terminate or suspend access to the App for any user who violates these Terms. Upon termination, you must cease all use of the App and uninstall it from your devices. Sections regarding intellectual property, disclaimers, and limitations of liability shall survive termination.
